These Terms of Service (henceforth identified as "theTOS") apply to applications (henceforth designated as "apps")provided by Vesey Studios, LLC through mobile devices or supported web browsers. By using the apps, you (henceforth identified as "the user") agree to the acceptance of the TOS. The TOS is a legally binding contract between the user and Vesey Studios. The TOS and conditions are subject to change at any time at the discretion of Vesey Studios and go into effect immediately upon being updated on the app or company website(www.veseystudios.com). The user accepts and agrees to be bound by any such changes automatically by continuing to use any apps following updates to theTOS. Failure to comply with the TOS may result in the user's termination of access to any related apps and content at Vesey Studios' discretion. Additionally, the user is subject to obeying any applicable posted rules (henceforth identified as "Guidelines"). Like the TOS, Guidelines are subject to change and to be considered part of the legally binding contract with the user.   

Guidelines

The user agrees not to harass, abuse, defame, stalk, or threaten other users. Additionally, the user will not discriminate against others based on gender, race, class, national original, ethnicity, religion, sexual orientation, or disability. Users will not create or transmit material that contains profanity, objectionable or obscene content, violates privacy and/or intellectual property laws, or contains software, files or computer code that interrupts destroys or limits the functionality of any computer hard ware, software or telecommunications devices.    

Registration

If the app requires the user to create an account, the user must provide complete and accurate information as requested, including his or her legal name and actual birthday.

‍Termination

Vesey Studios may terminate any user's account or access in full or part to any app at its sole discretion without notice or reason. Termination may include but is not limited to, account deletion, removal of the apps, and access to all offerings, content, and data within the apps.

‍Indemnity

The user agrees to indemnify and hold harmless Vesey Studios, its partners, subsidiaries, officers, trustees, employees, contractors, and other affiliates from any and all liabilities, claims, damages, and losses made by third parties due to any violations of these stated terms of service or resulting from or out of the use of the apps.

‍License

The user has a limited, non-exclusive license to use the app, including software and any related content for personal, non-commercial use only. The license is non-transferrable and may be revoked at Vesey Studios' discretion.

‍Intellectual Property

‍Unless stated otherwise, all content presented in the apps is the intellectual property of Vesey Studios. It owns all the rights, titles, and interests associated with the apps, including the technology such as source and object codes and content.  The content presented may only be used in the context of the app unless expressly given in the TOS or with prior written consent from Vesey Studios. Unless stated otherwise, the user should assume that all content found in the apps is protected by copyright, trademark, or other applicable intellectual property laws. Misuse of any content or intellectual property displayed in the apps is prohibited and subject to criminal prosecution. Apps may be discontinued or modified at any time without notice.  Vesey Studios is not liable to the user or any third parties for any suspension, modification, or discontinuance of the apps.  

In-App Purchases

Some apps may provide certain products and services for purchase with real money, including but not limited to extra functionality, bonus content, or special features. In-App purchases may be subject to additional terms and conditions provided when they are available.

‍User-Created Content

Some apps may allow users to create or submit original content.Users are solely responsible for any original content transmitted publicly or privately. User-created content may or may not be reviewed in advance by Vesey Studios. Users understand that some apps may contain objectionable or offensive material. Vesey Studios reserves the right to remove any user content posted toor shared through its apps at its discretion without prior notice. Additional terms and conditions may apply to apps that allow user-created content and provided when applicable.

Vesey Studios is committed to protecting any personal data we collect from users. Below we describe what information is collected and how it is obtained and used.  If an app requires the user to create an account, the user is responsible for protecting their login credentials. Usernames and passwords should be kept confidential and not shared with other users. In the event of unauthorized activity on your account, notify Vesey Studios and change your password immediately. Vesey Studios is not liable for any breach of security, damage, or loss arising from the user's failure to protect login credentials and other personal data. 

Minors

Unless otherwise noted, apps are not intended to be accessed or used by anyone under the age of 13.  Vesey Studios cannot and does not verify users ages. Any user that is considered a minor (under the age of 18)needs to obtain parental consent before using any apps or entering any personal data.

‍Third-Party Advertisements

Users may encounter third-party advertisements such as banner ads.Vesey Studios does not endorse or have control over the content displayed in any third-party advertisements.

‍Data Collection and Use

‍The site does not collect any personal information other than data actively submitted by the user on the "Contact Us" page, including the user's full name, mailing address, email, and telephone number.   

By providing your phone number, you consent to allow Vesey Studios representatives to contact you by phone regarding products and services. Apps may use cookies to track additional information.

Vesey Studios may use your personal information to contact you with information regarding our products and services.  We will not rent or sell your data to any third-party companies, although we may share it with our subsidiaries and affiliated partners.

Vesey Studios takes every available precaution to safeguard your personal information. Despite security protocols, Vesey Studios is unable to completely guarantee that unauthorized third parties will not obtain user's data. In the event of a data security breach, Vesey Studios will notify users per state and federal laws.

Vesey Studios does everything in its power to ensure that the information presented in their apps is accurate and up to date. However, we are not responsible for omissions or errors. There are no warranties or guarantees expressed or implied in regard to the operation or availability of the apps or that they are free of bugs or defects. Apps and content are "as-is"and on an available basis. Use and installation are at the user's own risk, including damage to any device as the result of installing or downloading the app or related content.
